The Town Council met this day in regular session at 7:00 p.m. in Sundance Council Chambers with Mayor Paul Brooks presiding. Roll call was taken by Mayor Paul Brooks with Council Members, Randy Stevenson, Callie Hilty, Brad Marchant, and Joe Wilson present.

Review Community Facility Rehabilitation DRAFT Grant Agreement

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to have the Mayor sign the Community Facility Rehabilitation Grant Agreement when we receive it from the state. All Ayes, MOTION CARRIED.

Review Stateline No. 7 DRAFT Contract

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to allow the Mayor instruct Mark to take the arbitration clause out of the contract. All Ayes, MOTION CARRIED.

NEW BUSINESS

Land Use and Planning Minutes of October 28, 2024

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to leave the current fee the same for the street cutting and add a clause that if the street is not brought back up to grade as sections as specified by the City, the City will fix it and the bill will be sent to the contractor. COUNCIL MEMBER HILTY MADE A FRIENDLY AMENDMENT, COUNCIL MEMBER MARCHANT SECONDED to add in that the month starts from the date of the application. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve the Policky application with the 4’ x 8’ landing. All Ayes, MOTION CARRIED.

24 Hour Catering Permit – Longhorn-Ladies Night

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to approve 24 Hour Permit for the Longhorn for Ladies Night. All Ayes, MOTION CARRIED.

Sheriff’s Agreement – Dogs at Large

Discussion was made and Mark Hughes, City Attorney, added Ordinance 8, 1986 to the Sheriff’s contract. He believes that he only had to add the ordinances needing enforced because that section was blank when the contract was signed. Discussion on fines was also discussed.

Review Ordinance 6, 2009 Snow Removal and Parking in Winter Months

Mayor Brooks brought snow removal up for discussion. The County pushes their snow from their parking lot into the street and the City hauls it away. Should the County haul their own snow from the courthouse? It was asked that Mayor Brooks have a friendly conversation with the County.

S. 21st Street Roadway Improvements Project

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER WILSON SECONDED a motion for the Mayor to sign an agreement between the City and Trihydro to look at the S 21st Street drainage. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to not renew R & S Plumbing Contractor’s License until he is in good standing. Once he pays the city for what he owes then he can renew after that. All Ayes, MOTION CARRIED.

Mark Koep, Land Use Planning Board Member, reported to the council about Ordinance 12, 2002 and Resolution 2, 2003 and changes that the Land Use and Planning Board would like to see. Suggestions on how to make certain that a trench cut in a city street/alley should be fixed sooner.

Kristy Durfee brought in a petition to enforce the dogs at large ordinance.

REPORTS

Crook County Sheriff Jeff Hodge reported 137 incidents for October 2024. They have been dealing with a lot of dogs at large and barking dogs. Working with Mark Hughes to add Ordinance 8, 1986 – Regulating Dogs and Other Animals within the Town Limits to the Sheriff’s enforcement contract.

Mac Erickson, Public Works Director, reported that all services have been reconnected on Ryan Street Project and they are in cleaning up. November 5, 2024 was the final day to pick up yard waste. They will be picking up yard waste containers for the winter to inventory them. Will return the yard waste cans in the spring. Planning on doing a test pit next week for the 3rd Street Waterline Project. 11 galvanized pipes will be replaced when 3rd Street and Cleveland Waterline Project is done. Letters were mailed out on November 3, 2024 per EPA to let residents know that there is an unknown area where we do not know if it is lead or galvanized piping between the water main and the curb stop.

Gari Gill, Fire Chief, reported that they sold Engine 2 and the F250. Waiting on the check to send titles. Wanting to sell the Tahoe by sealed bid. They would like to keep track of water that the fire department uses to show Mac where the water is going. Webinar on November 8th on OSHA regulations. The Town Fire Departments are cost prohibitive.

Ryan Christianson, Trihydro, reported that the landfill monitoring is ongoing. Reviewing drawings for the 3rd Street Waterline from the contractor. South 21st Street Roadway – coordinate closely with EA. Looking at the street elevation and what makes sense for everybody.

Jeremy Holt, Economic Development, reported that the board would like to beet with local businesses to get their opinion on where they would like to see economic development and the chamber to go. A subcommittee will be doing this.

Theresa Curren, Clerk Treasurer, reported that she has been busy with four different grants of just being awarded to finishing them out. Been working on the contracts for the grant agreement and engineering for Old Stoney Phase II. The Mineral Royalty Grant for the 3rd Street Waterline will be awarded at the February SLIB meeting.

Mark Hughes reported that he reviewed the Community Facility Rehabilitation Grant Agreement. He didn’t see any problems with it other than there are a few blanks that need to be filled in. Also reviewed the AIA Architect Contract for Old Stoney. His big concern is how to solve big disputes. The contract has a section in it that we will go to arbitration through the American Arbitration Association. He would ask that the contract be changed to agree to use the courts of

Crook County for arbitration if needed.
