NOTICE OF INTENT OF TRUSTEES TO HAVE PROPERTY OF SETTLOR DISTRIBUTED AS PERMITTED UNDER TERMS OF TRUST

THE UNDERSIGNED, on behalf of the Nels J. Smith Revocable Trust dated November 9, 2004, as amended, pursuant to Wyo. Stat. § 4-10-507(ii), hereby gives notice of the intent of the trustees to have the property of the settlor distributed as permitted under the terms of the Trust.

YOU ARE HEREBY NOTIFIED that Nels J. Smith established the Nels J. Smith Revocable Trust dated November 9, 2004, as amended December 29, 2009, and as amended and restated November 16, 2018 (the “Trust”). The name and address of the successor Trustees of said Trust are:

Any creditors having a claim against the assets of the Trust shall file a claim in writing to the undersigned within one hundred twenty (120) days from the first date of publication of this Notice. Said claim shall include: (1) the exact outstanding balance of the indebtedness that is claimed as being owed by the settlor or the Trust; (2) an itemization of the outstanding balance; and (3) the name and address of the person to whom communications regarding said claim shall be directed.

If you fail to file a claim or to commence a judicial proceeding to contest the validity of the Trust within the allotted time, you are forever prohibited from making any claim against the assets of the settlor’s Trust or commencing any judicial proceeding against the settlor or the assets of the settlor’s Trust.
