PROCLAMATION OF ELECTION OF THE PROPOSED YELLOWSTONE L&R RANCH

IMPROVEMENT AND SERVICE DISTRICT

PLEASE TAKE NOTICE that the Crook County Commissioners have directed that an election shall take place on the organization of the proposed Yellowstone L&R Ranch Improvement and Service District.

DATE OF ELECTION: The election shall take place by mail ballot on August 20, 2024.

WHO CAN VOTE: W.S. 18-12-102(a)(vii) provides that “Elector” or “voter” means a person who is a qualified elector or an owner of land in the district, including any corporation, partnership or association owning land in the district provided the individual who casts the vote for a corporation, partnership or association presents the election judge with a written authorization to vote for the corporation, partnership or association. No person is a qualified elector who is under eighteen (18) years of age, a mentally incompetent person, or who has been convicted of a felony and his civil or voting rights have not been restored. In applying provisions of the Special District Elections Act of 1994 to this act, the terms “elector” or “voter” shall include qualified electors and landowners. For the purpose of this formation election, any voter not otherwise registered who makes an affidavit (form available at the Clerk’s Office) evidencing his qualifications to vote is deemed registered for that election.

PROPOSED QUESTION: The question shall read: “Shall an improvement and service district named “Yellowstone L&R Ranch Improvement and Service District” be formed?”

PURPOSE: The election shall be held to determine whether the Yellowstone L&R Ranch Improvement and Service District shall be organized and to vote for three (3) qualified electors residing within the district or an owner of land in the district, who shall constitute the board of directors of the district, if organized, to serve as follows: One (1) Director shall serve for four (4) years and two (2) shall serve for two (2) years after formation of the district and until their successors are elected and qualified at the regular scheduled subsequent director election as provided in W.S. 22-29-112. The following people are willing to serve on or file as candidates for election to the initial board of directors: Les Lindskov, Jim Roquemore and Brenda Mattison. All individuals wishing their name to appear on the ballot must file an application with the Crook County Clerk’s Office. The filing period is April 27, 2024 through May 12, 2024.

a. The general purpose of the proposed district is to repair and maintain the common roads within the proposed district; however, the proposed district will not maintain any private easements or right of way located within the district boundaries. The proposed district may also provide subdivision governance for the homeowners within the district and may provide any other legal purpose authorized by law.

POLLING PLACE: Crook County Clerk’s Office at the Courthouse in Sundance, Wyoming, from 8:00 a.m. to 4:00 p.m., August 20, 2024.

METHOD: NOTE!!! The election will be by MAIL BALLOT. (All known eligible electors will be mailed a ballot beginning July 7, 2024.) All ballots must be in the Crook County Clerk’s Office no later than 5:00 p.m. on August 20, 2024, to be counted.

NOT RECEIVED OR SPOILED BALLOTS: W.S. 22-29-116(a)(v) No sooner than twenty-five (25) days and no later than 4:00 p.m. on Election Day, mail ballots shall be made available at the Crook County Clerk’s Office. W.S. 22-29-116(a)(vi) A voter may obtain a replacement ballot if the ballot was destroyed, spoiled, lost, or for some other reason not received by the voter. To obtain a replacement ballot, the voter must sign a sworn statement specifying the reason for requesting the replacement ballot. The statement shall be presented to the election official no later than 4:00 p.m. on Election Day.

BALLOT COUNTING: Ballots received by the County Clerk’s Office will be counted on August 20, 2024 at 5:00 p.m. A mail ballots shall be valid and counted only if it is returned in the return-verification envelope, the envelope is signed and completed by the voter to whom the ballot is issued.
