The Town Council met this day in regular session at 7:00 p.m. in Sundance Council Chambers with Mayor Paul Brooks presiding. Roll call was taken by Mayor Paul Brooks with Council Members, Joe Wilson and Brad Marchant present and Randy Stevenson and Callie Hilty appearing by phone.

Trihydro Cost Proposal for 2024 Environmental Monitoring and Reporting for the Sundance Landfill

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to approve the Cost Proposal for the 2024 Environmental Monitoring and Reporting for the Sundance Landfill between Trihydro and the City of Sundance. All Ayes, MOTION CARRIED.

Land Use and Planning Minutes of January 22, 2024

Ordinance 1, 2024 – Black Hills Energy Franchise Agreement

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve Ordinance 1, 2024 Black Hills Energy Franchise Agreement on its First Reading. All Ayes, MOTION CARRIED.

Pledgee Agreement Form

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to acknowledge the Pledgee Agreement and those that need to sign it. All Ayes, MOTION CARRIED.

Utility Write-offs

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to write off utility accounts 78.4 and 301.5. All Ayes, MOTION CARRIED.

REPORTS

Paul Stilles, Leo Riley and Company, reported on the 2022-2023 City of Sundance Audit.

Naomi Jacobson and Kendall Livingston reported on the Sundance Kids Daycare. They thanked the City and the community for the support. The Daycare is no longer in the red due to fundraising and the City’s help. Need to update Safety protocols and would like to work with Mac replacing and adding new locks. Need a new washing machine. Serving 50 kids between daycare and preschool.

Deputy Sheriff Kody Lenz reported 117 calls for the month.

Public Works Director, Mac Erickson reported that once the 3rd Street Cleveland Survey from Engineering Associates is signed, they will get the information to Trihydro so they can get started. Waddell sewer design is in the final stages. Hi Mile drainage is also being worked on. Lead & Copper Inventory continues and is due in October 2024. Mac would like to replace any galvanized pipe.

Fire Chief Gari Gill reported that on January 12-13, 2024 subzero temperatures damaged rig 1 and rig 3. They have Engine 1 up and running and Engine 3 will cost $5,000. Department is doing the labor themselves. OSHA is pushing severe rules and there are several states that are pushing back, including Wyoming. They are expecting PPE to be replaced every 10 years when it is usually every 15-20 years.

Economic Development member Jeremy Holt reported that they are waiting on the government for several things and there isn’t much to report.

Ryan Christiansen, Trihydro, reported that 3rd Street and Cleveland is under a 60% design. Project Manual is being started. Worked on a new cost estimate for 3rd Street Culvert to see if we can get emergency funds. Waddell sewer – Engineering Associates is working on elevations. Will be working on Hi Mile drainage next.

Clerk Treasurer, Theresa Curren, reported that the Grant Agreement for the Safe Streets For All Economic Development Grant is half done. Will be working with the Economic Development board to finish it. Attended several zoom meetings and webinars in January for classes and grant information. Currently working on 10 grants; seven that have been awarded, three that are waiting to see if are awarded. WWC Engineering found a Pickleball grant available from Wyoming Outdoor Recreation. Turned in grant for $135,000 with a 10% match hoping to hear within 30 days to see if we are awarded it.

City Attorney Mark Hughes reported that the council could pass the first reading of October 1, 2024 Black Hills Franchise Agreement, but he would like to see the Wyoming Statutes language added. Mr. Hughes also pointed out that there is no dollar amount listed in the agreement or the promise of any delivery of gas. Stacie McDonald of Black Hills reported that she will work with Mark Hughes.
