The Town Council met this day in regular session at 7:00 p.m. in Sundance Council Chambers with Mayor Paul Brooks presiding. Roll call was taken by Mayor Paul Brooks with Council Members, Callie Hilty, Randy Stevenson, Joe Wilson and Brad Marchant present.

Trihydro Update
City Engineer Michelle Sell introduced Ryan Christianson and Ted Gillanwater from Sheridan who are now working for Trihydro and will be helping with Sundance projects. Ms. Sell reported that they are moving forward with the 3rd Street Waterline Project and are coordinating surveying work with Engineering Associates. Also will be coordinating a meeting with WYDOT on Cleveland Street work. They are also looking at construction cost for four potential projects for Sundance to be ready for funding opportunities when they arise.
Wyoming Local Government Liability Pool Board Nominations
COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to nominate Mayor Paul Brooks for the Municipality Position to the Local Government Liability Pool Board. All Ayes, MOTION CARRIED.
Land Use and Planning – Variance for The Dogpound Property

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to allow Mayor Paul Brooks to sign Resolution of Support for Resolution 13, 2023 RESOLUTION AUTHORIZING SUBMISSION OF APPLICATION TO THE WYOMING BUSINESS COUNCIL UNDER THE COMMUNITY FACILITY REHABILITATION GRANT PROGRAM ON BEHALF OF THE GOVERNING BODY OF THE CITY OF SUNDANCE and the associated grant application. All Ayes, MOTION CARRIED.
Letter to State Lands and Investments to Request Lower Interest Rates
COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to allow Mayor Paul Brooks to sign a letter to the Wyoming State Lands and Investments Board asking to lower interest rate on SRF Loan-SW Tank Project - #DW215 from 2.5% to 1.5%. All Ayes, MOTION CARRIED.
Ordinance 2, 2023 AN ORDINANCE AMENDING ORDINANCE 8, 1986 Number of Dogs Allowed by One Home
COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to approve Ordinance 2, 2023 with the change to read “No more than three (3) dogs in any one home or residence shall be allowed.” All Ayes, MOTION CARRIED.
Other
Norm Olsen asked about a residential property that is running a commercial business and has a semi truck and other commercial trailers parked on the property.
COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER WILSON SECONDED a motion to allow City Attorney, Mark Hughes, to write a letter to the guy that has formed a business on his property along the frontage road. All Ayes, MOTION CARRIED.
Kendall and Janie, Kid Prints Daycare Board Members, reported on the current status of the daycare. Kid Prints will no longer be receiving a $60,000/year funding from COVID Relief funds. The funds ended in September 2023. Plan to increase tuition prices by 5%, they would then be running on a $22,000 deficit. They have mailed out over a hundred letters asking for sponsors for 2024. Need to figure out how to increase the number of children at the daycare and at the same time making sure they are in compliance with the state. May need to look at repurposing space and adding one bathroom.
Jason Coder asked for a variance on the zoning for the empty lot where Higbees Café was at under General Business. They would like to get a used vehicle license to sell used ATVs and motorcycles.
REPORTS
Deputy Lenz, Crook County Sheriff’s Office, reported 121 calls for the month. They have been receiving several calls and dogs and would like to know how close we are to being able to start writing tickets for dogs at large, etc.
Fire Chief Gari Gill reported that he and Mac, Public Works Director, met with the air ambulance to try and figure out the best place to land. They will be meeting with the pilot that is coming on October 17th. Mr. Gill reported that they received a SCEA bottle filling station. They are down to 17 people. On November 2nd, they will find out if they receive the ARPA grant for the addition to the fire hall.
Public Works Director, Mac Erickson reported that they will have the permit to construct soon on the Ryan Street Project.
Jeremy Holt, Economic Development Board, reported that they are working with the Sundance State Bank to order $2 bills to see how much money stays in Sundance. The first grant that they went for will be awarded sometime in October.
Theresa Curren, Clerk Treasurer, reported that Jan Denzin will help balance the F66 audit. In the process of writing the application for the CFR grant for Old Stoney. Attended WAMCAT Fall Institute last week. Planning a retirement party for Tom Davis on October 18th. Asked council about being able to get a credit card machine so people can charge building permits, contractor licenses, utility deposits, landfill, etc.
Councilman Joe Wilson reported that he is on the Crook County Commissioner Agenda at 10am on October 4th to discuss landfill issues.
Councilwoman Callie Hilty asked if there was a process to vacate a street. There is an ordinance and a state statute that a person will need a Petition to Vacate and then council needs to vote on the vacation. Once the vacation is approved one side of the vacated street will then be owned by the adjacent land owners. Also, discussion on whether a drainage could be put in on City property by a landowner.
