NOTICE OF INTENT OF SUCCESSOR TRUSTEE OF THE FIRST RESTATEMENT OF THE DECLARATION OF TRUST OF JANICE C. SMITH DATED THE 25TH DAY OF MAY, 2000 TO DISTRIBUTE TRUST PROPERTY; NOTICE TO CREDITORS

TO ALL PERSONS INTERESTED IN THE FIRST RESTATEMENT OF THE DECLARATION OF TRUST OF JANICE C. SMITH DATED THE 25TH DAY OF MAY, 2000:

You are hereby notified Donald E. Smith, Successor Trustee of the First Restatement of the Declaration of Trust of Janice C. Smith dated the 25th day of May, 2000 (the “Trust”), intends to have the property of the Settlor, Janice C. Smith, distributed as permitted and otherwise required under the terms of the Trust.

You are further notified that a creditor of the Settlor, Janice C. Smith, or the Trust may file a claim against the assets of the Trust or commence a judicial proceeding to contest the validity of the Trust which became irrevocable on the date of the death of Janice C. Smith, which occurred August 29, 2023, within the earlier of:

(a) two (2) years after the Settlor’s death;

(b) one hundred twenty (120) days after the first publication of this notice of the intent of the Successor Trustee to have the property of the Settlor distributed as permitted under the terms of the Trust; or

(c) one hundred twenty (120) days after known creditors have been mailed notice, by certified mail, return receipt requested.

A creditor failing to file his, her, or its claim with the Successor Trustee or to commence a judicial proceeding to contest the validity of the Trust within the times provided pursuant to Wyoming Statute Section 4-10-507 is forever prohibited from making any claim against the assets of the Trust or commencing any judicial proceeding against the Settlor, Janice C. Smith, the Successor Trustee, or the assets of the Trust.

All claims and any documents for any actions with respect to the Trust or its assets are to be delivered to the Successor Trustee as follows:
