ORDINANCE NO. 3, 2022
AN ORDINANCE REGULATING THE DRILLING OF AND MAINTENANCE OF WATER WELLS WITHIN THE SUNDANCE CITY LIMITS, SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SUNDANCE, CROOK COUNTY, WYOMING:
SECTION 1: WATER WELLS WITHIN THE CITY OF SUNDANCE CITY LIMITS
Any water well drilled within the City limits shall meet the minimum standards as required by the American National Standards Institutes (ANSI) standards for American Water Works Association’s (AWWA) Water Well Standards.
SECTION 2: APPLICATION TO EXISTING, MODIFYING OR DEEPENING OF EXISTING WATER WELLS
If any existing water well should fail all replacement water wells, further drilling and/or modification of an existing water well shall meet the ANSI/AWWA Standards.
SECTION 3: BUILDING PERMIT APPLICATIONS
All property owners desiring to drill or deepen a new or existing water well shall submit a building permit application to the City with an application to drill a water well with proof of receipt of the said application to the State Engineer’s Office prior to the building permit being issued.
SECTION 4: CONNECTION TO THE CITY WATER SYSTEM
No water wells drilled within the City limits shall be connected to the City’s water system.
SECTION 5: APPLICATION
The provisions of this Ordinance shall not apply to any water well that is legally permitted as of the effective date of this Ordinance.
SECTION 6: USE OF WATER
All water pumped from a water well drilled and completed within the City shall be for domestic and irrigation uses only. No water well shall be tied into the City of Sundance lines.
SECTION 7: VIOLATIONS
Any individual found in violation of any provision of this Ordinance, shall be guilty of a misdemeanor and be subject to a fine of up to $750.00, six (6) months in jail or both.
SECTION 8: SEVERABILITY
Should the Courts of this State or the United States declare any section, provision, paragraph, clause, sentence, phrase or part of this Ordinance invalid or unconstitutional or in conflict with any other section, provision, paragraph, clause, sentence, phrase or part thereof of this Ordinance, then such decision shall affect only the section, provision, paragraph, clause, sentence, phrase or part thereof declared to be unconstitutional or unauthorized and shall not affect any other part of this Ordinance.
SECTION 9: EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage, approval and publication.
