Suspended sentence for Cheyenne man

A Cheyenne man has been given a suspended sentence on possession charges after the person he was staying with in Sundance requested that he be removed from their residence.

A Crook County Sheriff’s Office deputy investigated a disturbance and unwanted person at a residence in Sundance on September 30, 2021 when the occupant asked for their guest, Clinton Bruguier, to be removed. The occupant stated that Bruguier kept some marijuana in the bathroom cabinet and they wanted it, and Bruguier, removed.

The deputy reports observing a metal smoking pipe in the bathroom and detecting the odor of burnt marijuana. Bruguier allegedly admitted to smoking marijuana prior to the deputy’s arrival and said he threw out the rest of it.

He allegedly also claimed ownership of the pipe. The deputy reports that the bedroom in which Bruguier was staying smelled strongly of burned marijuana.

The occupant consented to a search of the resident, but no other marijuana or paraphernalia was located. The burned residue allegedly tested positive for marijuana and Bruguier was placed under arrest for possession of a controlled substance in an amount less than three ounces.

Bruguier pled guilty to a felony count of possession of a controlled substance, third or subsequent offense, with five known prior convictions in South Dakota between 2007 and 2016.

Judge Matthew F.G. Castano sentenced Bruguier to between four and five years of incarceration, to be suspended pending successful completion of three years of supervised probation, and a $500 fine.
