The Town Council met this day in regular session at 7:00 p.m. with Mayor Paul Brooks presiding.

Approve Minutes of the City Council Regular Meeting of June 1, 2021 as published. Approve the June adjustment report. Approve the June Paid Invoice report. Approve the July Unpaid Invoice Report. Accept the American Relief Funds. Catering Permit-Turf-O’Brian Fund Raiser. MOTION CARRIED (per consent agenda).

City Engineer Karla Greaser reported on the Sundance West Tank Project. The contractor, Timberline Services has requested final completion. Trihydro has processed the final payment application and prepared Change Order # 3, which is a deduct in the amount of $12,964.40. MS. Greaser stated the council had a draft for review and the final would be sent.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to approve the final completion of the project and the final copy of Change Order No. 3, when it is received. All Ayes, MOTION CARRIED.

MS Greaser reported Trihydro has been reviewing material submittals from the contractor on the Sundance Kid Tank Project. A pre-construction meeting will be scheduled for the end of July and the project will hopefully be started by mid August. Trihydro will be teaming with Bearlodge Engineering for field oversight work.

Clerk Treasurer Kathy Lenz reported on Sundance Square Park. The grand opening was very well attended. The Sundance State Bank has announced they will be funding the outdoor movie screen projector and sound system. MS Lenz provided the council with the bid amount of the project. Council and Mayor Brooks recognized the generosity of the Banks gift.

COUNCIL MEMBER STEVENSON MOVED, COUNCIL MEMBER HILTY SECONDED a motion to approve ORDINANCE NO. 6, 2021; ORDINANCE 7, 2021 AND ORDINANCE 8, 2021 – FRANCHISE AGREEMENTS with Sundance Cable T.V. Inc.; Visionary Communications Inc.; and Powder River Energy Corporation - SECOND READING. All Ayes, MOTION CARRIED.

City Attorney Mark Hughes is working with Range Telephone Coop on details of that franchise agreement.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to approve ORDINANCE 4, 2021- AN ORDINANCE AMENDING ORDINANCE NO. 2, 2013, PERTAINING TO SHIPPING CONTAINERS, QUONSETS, PORTABLE CONTAINERS, OFF-PREMISES SIGNS, OUTDOOR ADVERTISING SIGNS. Including ORDINANCE NO. 6 & 7 2014 FENCES - SECOND READING. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to allow the Mayor to sign a utility easement with Crook County School District No. 1. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to allow the Mayor to sign the contract with Hot Iron Inc. of Gillette WY for the Sundance Kid Tank Project. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to accept the janitorial bid from Visible Difference in the amount of $8,400.00. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to allow the construction of a mountain bike trail on the City Property known as the West Pasture. All Ayes, MOTION CARRIED.

City Attorney Mark Hughes advised council on uses of City property.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER STEVENSON SECONDED a FRIENDLY AMMENDMENT to the motion which states the use of the mountain bike trail will be reviewed on a term of two years. All Ayes, MOTION CARRIED.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER HILTY SECONDED to approve Joe Wilson as the voting delegate at the Wyoming Association of Municipalities 2021 Summer Convention. All Ayes, MOTION CARRIED. COUNCIL MEMBER WILSON recused himself from the vote.

COUNCIL MEMBER MARCHANT MOVED, COUNCIL MEMBER WILSON SECONDED a motion to approve RESOLUTION NO. 7, 2021 REGARDING BUDGET AMENDMENT. All Ayes, MOTION CARRIED.

COUNCIL MEMBER HILTY MOVED, COUNCIL MEMBER MARCHANT SECONDED a motion to approve the June 28, 2021 Land Use Committee Meeting minutes as presented. Approve items B,C,D and E. Excluding items A & F. All Ayes, MOTION CARRIED.

Discussion was held.

COUNCIL MEMBER WILSON MOVED, COUNCIL MEMBER STEVENSON SECONDED a motion to approve a setback variance of 2’ for Jon Davis at 212 North West St. All Ayes, MOTION CARRIED.
